#1 – Introduction

Our Terms of Use ("Terms", "Terms of Service", "Terms and Conditions") tell you a set of rules, policies, principles and acceptable behavior to which you must agree in order to use or access our Services shared offline and/or online through our website, app or social media (collectively our "Services"). By using Mother Laundry Ltd ("Mother Laundry", "We", "Us"), you acknowledge that you’ve read and accepted these Terms. If you disagree with any part of these Terms then you may not access our Services. We may terminate or suspend your access to our Services immediately, without prior notice or liability for any reason whatsoever, including without limitation, if you breach any of these Terms.
[1.1] Mother Laundry reserves the unassailable right to refuse cleaning any garment.
[1.2] Service days and turnaround time vary by order. Mother Laundry will make its best effort to adhere to our Service schedules. However, we do not guarantee turnaround times and assume no responsibility for any damages that may occur due to a delay in service.

#2 – Term Definitions

[2.1] A User (a "Client") is a person or a company or an organization that has placed an order.
[2.2] Ordering is the process where a Client places a request for collecting their laundry from them for our Services "OR" Ordering is the process where a Client drops off laundry at our premises for our Services.

#3 – Prior Information

[3.1] When communicating on behalf of a company or organization instead of as a person, you ensure that you have the authority to act on their behalf.
[3.2] Please carefully read and understand these Terms of Service. The Client's submission of an order (as defined above in 2.2) whether offline or online indicates the Client's full agreement to all these Terms of Service.

#4 – User Responses

You agree to grant Mother Laundry the non-exclusive and unlimited right to reprint, use directly, or make derivative use of any comments, responses, posts, or other information communicated to it through its website (hereinafter “Responses”). Mother Laundry shall not in any way be required to treat Responses as confidential, and shall be entitled to use Responses for any commercial or non-commercial purpose permitted to it without any compensation to you or any other person contributing to the Responses. You acknowledge by submitting Responses that you own whatever content you submit, and that our use of your Responses will not infringe upon the rights of any third party.

#5 – Rights to Intellectual Property

[5.1] All intellectual property rights on our Website are owned or licensed by us. All such rights remain unassailable. You MUST NOT copy, download or print any excerpt, content, page, resource or any other material from our Website for your own personal or commercial use.
[5.2] In case on infringement, we will initiate legal actions such as notice and takedown claims (under the Digital Millennium Copyright Act (DMCA) ), and domain name abuse claims under the Domain Name Dispute Resolution Policy with the WIPO Arbitration and Mediation Center . Futhermore, we'll act under Uganda's Legal Framework including the Constitution of Uganda, the National Intellectual Property Policy , and others.

#6 – Liability

[6.1] The Client acknowledges that our laundry service, dry cleaning, ironing, mending, pickup & delivery, and all our Services include certain risks, including the possibility of clothes and related items being lost or damaged. Mother Laundry will do everything possible to prevent situations like this from occurring, but if they do, the company will work with the Client to resolve the problem. Without limiting the above, and to the extent allowed by required applicable law, our liability shall not exceed five (5) times the cost of cleaning the item or the depreciated value of the item (whichever is lower).
[6.2] The Client is responsible for removing collar stiffeners and cufflinks from shirts, as well as empting the pockets.
[6.3] It is the Client’s responsibility to ensure that all items given are practicable to be subject to our Services that the Client wants.
[6.4] The items of the Client shall hold for no more than one month. After one month, the Client’s possessions will be donated to charity.
[6.5] Within 24 hours of delivery, complaints must be received. Before any claim for payment for damage to an item(s) may be processed, our cleaning team must be allowed to collect the item(s) and try to repair the damage(s) caused. Any such claims made after that period will not be considered.
[6.6] Mother Laundry shall not be liable for items with a defect in the design, material, dyes or construction, have residual stains or have accessories or ornaments which don’t withstand cleaning. Any damage or stains discovered before cleaning are to be taken as having occurred before collection.
[6.7] We will do our utmost to remove stains, however there is no guarantee that every stain can be removed on all fabrics. Since extra care is taken at all times while offering our Services, we will not waive charges due to our inability to remove a stain from any of the garments you give to us.
[6.8] Please check and confirm the number of the items at the time of delivery of your garments. Any lost item(s) must be reported immediately to us within 24 hours of delivery. Any such claims made after that period will not be considered.

#7 – Complaints

[7.1] If you have any complaints, please contact us online or through phone, email or WhatsApp.
[7.2] You agree that any issues should be handled by us rather than the courier. In addition, you agree to follow our complaint procedures (as precisely stated in 6.5 above), and other instructions provided under our user regulations.

#8 – Prices & Payment

[8.1] At any time, we have the right to change our rates as we may deem fit.
[8.2] Unless otherwise agreed, full payment should be made by the Client during drop-off of laundry at our premises or as we pick it up from theirs.

#9 – Our Liability to You

[9.1] In the unlikely event that an item is lost or damaged, Mother Laundry will refund you according to industry standards. Our total liability to you for each item shall not exceed five (5) times the price we charge for cleaning the item or the depreciated value of the item (whichever is lower), but not more than USD $25.00, provided you provide evidence of purchase clearly showing the date of purchase and the item’s price.
[9.2] We will compensate (in line with 9.1) for loss or damage caused by Our Negligence, given the following subparagraphs.
9.2.1 – Any single item valued at more than $50.00 would not be guaranteed by us.
9.2.2 – We would not be liable to you for any completely avoidable loss or corrigible damage.
[9.3] If you use our Services for commercial, business, or reselling purposes, We will not be responsible for any loss, business interruption, or opportunity.
[9.4] We will not be responsible for any loss or damage (including, but not limited to, color loss, shrinking, or other damage) caused by any of the following:
9.4.1 failing to inform us of any specific cleaning requirements or instructions;
9.4.2 the absence of a label stating cleaning instructions on the item;
9.4.3 whatever damage to the item that existed at the time of collecting;
9.4.4 whatever damage caused due to the load wash service (wash by per kg);
9.4.5 our acceptance of the items for which we have committed to supply Services;
9.4.6 any foreign or dangerous thing left in and on the item, such as pins, jewelry, money, pencils, buttons or embellishments, belts, and so on;
[9.5] We are not responsible for any indirect or consequential losses.
[9.6] We are not responsible for any damage to buttons, zips, or other similar items.
[9.7] If we pay compensation for damage to an item(s) in our care, Mother Laundry reserves the right to keep the damaged item(s) permanently.

#10 – Events Beyond Our Control

[10.1] We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms of Service that is caused by an Event(s) Beyond Our Control.
[10.2] An Event Beyond Our Control means any act or event beyond our reasonable control including (without limitation) strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, power blackout or brownout, explosion, accidents, adverse weather, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or closure or failure of public infrastructure or public or private telecommunications networks.
[10.3] If an Event Beyond Our Control takes place that affects the performance of our obligations under these Terms:
10.3.1 We will contact you as soon as reasonably possible to notify you; and
10.3.2 Our obligations under these Terms will be adjourned and the time for performance of these obligations will be extended for the duration of the Event Beyond Our Control. Anything foreseeable will be communicated too.

#11 – Links from our Website

Our website may contain links to other websites that are not under our control. We are not responsible for the accuracy, relevancy, copyright compliance, legality, or any other aspect of the content of those websites. The inclusion of any links does not imply an endorsement or approval by GFC of any website, solution, product, or Service for any reason whatsoever.

#12 – Transfer of Rights

[12.1] We may transfer all or some of our rights or obligations under this Agreement if we take appropriate efforts to ensure that your rights are not affected. You may not transfer any of your rights or obligations under this Agreement without our prior written authorization as it’s personal to you.

#13 – Updates & Changes

[13.1] Mother Laundry reserves the right to change, modify, add, or delete portions of these Terms of Service at any time, at its discretion. From time to time, we may change, modify, add, or delete portions of these Terms, and as a User you must always consult our most recent version.
[13.2] Mother Laundry reserves the right to make changes, modifications, additions to, and deletions from the content available on this Website at any time, at its discretion. This right includes but is not limited to the right to discontinue for perpetuity or any limited period the availability of any webpages, resources, and of any solutions, products and/or services offered on this Website.

#14 – Survival & Severability

If any provision of these Terms is found unenforceable, the balance of the Terms will remain in full force and effect.
